1. Acceptance of these terms
By accessing or using Orcha, you agree to these terms and any policies referenced in them. If you use Orcha for an organization, you represent that you have authority to bind that organization to these terms.
If you do not agree to these terms, do not access or use the services.
2. Accounts and security
You are responsible for providing accurate account information, protecting your login credentials and API keys, and all activity performed through your account. Notify us promptly if you believe an account or credential has been compromised.
3. Subscriptions and billing
Paid features may require a subscription. Prices, usage limits, billing intervals, and renewal terms are presented when you purchase a plan. Unless stated otherwise, fees are non-refundable except where required by law.
You authorize Orcha and its payment providers to charge applicable fees and taxes using the payment method associated with your account.
4. Acceptable use
You may not use the services to:
- violate applicable law or another person's rights;
- upload malware or attempt to gain unauthorized access to systems or data;
- interfere with, overload, or bypass security controls protecting the services;
- resell or misuse the services except as expressly permitted by your plan; or
- use generated credentials, APIs, or MCP tools outside their authorized scope.
5. Your content
You retain ownership of content you submit to Orcha. You grant Orcha a limited license to host, process, transmit, back up, and display that content only as needed to provide, secure, and improve the services.
You are responsible for ensuring that you have the rights and permissions needed to submit and use your content through the services.
6. Orcha property
Orcha and its licensors retain all rights in the services, software, documentation, branding, and other materials we provide. These terms do not grant you ownership of the services or permission to use our marks without prior written approval.
7. Third-party services
The services may connect to third-party products. Your use of those products is governed by their terms and privacy practices. Orcha is not responsible for third-party products or for changes they make to their services.
8. Service changes and availability
We may update, suspend, or discontinue features and may apply reasonable usage or security limits. We will provide notice when reasonably practicable if a material change adversely affects a paid service.
9. Suspension and termination
You may stop using Orcha at any time. We may suspend or terminate access when necessary to address a security risk, legal requirement, nonpayment, or material breach of these terms. Provisions that by their nature should survive termination will remain in effect.
10. Disclaimers and liability
To the extent permitted by law, the services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the extent permitted by law, Orcha will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities arising from use of the services.
11. Changes to these terms
We may update these terms as our services or legal obligations change. We will post the revised terms and update the date above. Continued use after an update becomes effective means you accept the revised terms.
